Newid mewn deddfwriaeth gynllunio / Change in planning legislation

Rydym yn ysgrifennu i roi gwybod i chi am newid mewn deddfwriaeth cynllunio mewn perthynas â datblygiad a ganiateir gan berchennog tŷ a ddaw i rym ar 30 Medi 2013.

Mae gan berchnogion tai yr hawl i wneud rhai datblygiadau heb fod angen caniatâd cynllunio. Ar hyn o bryd, mae hyn yn ymwneud yn bennaf â chapasiti ciwbig unrhyw estyniadau y byddant yn eu hadeiladu. Ond, mae’r rheolau newydd yn ymwneud fwy ag effaith cyffredinol a dimensiynau’r datblygiad.

Oherwydd cymhlethdod y ddeddfwriaeth newydd a swm yr wybodaeth fyddai ei hangen i alluogi rhoi cyngor ar yr angen am ganiatâd cynllunio, rydym wedi penderfynu y gellir rhoi cyngor ysgrifenedig dim ond trwy gyflwyno Tystysgrif Defnydd Cyfreithiol. Mae hyn yn rhoi cyngor cyfreithiol i’r ymgeisydd yn hytrach na barn anffurfiol.

Mae Llywodraeth Cymru wedi cynhyrchu canllaw syml ar gyfer Perchnogion Tai ac rwy’n ei atodi er gwybodaeth. We write to inform you of a change in planning legislation with regard to householder permitted development which will take place on 30th September 2013.

Householders have a right to carry out certain development without the need for planning permission. Currently, this relates mostly to the cubic capacity of any extensions that they may carry out. However, the new rules are more concerned with the overall impact and dimensions of the development.

Due to the complexity of the new legislation and the amount of information that would be required to enable advice to be given on the need for planning permission, we have decided that written advice can only be given through the submission of a Certificate of Lawful Use. This provides the applicant with legally binding advice rather than an informal opinion.

Welsh Government have produced a fairly simple to read guide for Householders which I attach for your reference.
