Ref: LEJ/048128, Removal of an existing Section 52 Legal Agreement and to Replace it with a Section 106 Undertaking Located at Crud-y-Hafod, Plas Hafod, Hafod Road, Gwernymynydd.

The Council resolved to object to the proposal for the following reasons:-
The dwelling known as Crud-y-Hafod had a Section 52 Legal Agreement as per planning permission, 1986, ref: 86/190, this condition was agreed by this Council to ensure that no further development took place at the Plas Hafod Hotel location. To remove this Section 52 would in the opinion of this Council then allow further development to take place outside of the existing Village Envelope constituting building in open countryside, breaching the concept of a green belt and contrary to the policies of Flintshire County Council.
The Section 106 Undertaking is too loose in its description and in the conditions to be imposed; it would permit a distant connection to the Plas Hafod Hotel to be used as a point of argument to allow further development on the site.
This Council is extremely concerned that the site would be developed to the extent that another dwelling may be proposed and agreed or that the property Crud-y-Hafod would be converted to allow multiple occupation.
